2018 Fundamentals Webinar: Fundamentals of DUI Law - Birchfield, Implied Consent, and Beyond

In June, 2016, the U.S. Supreme Court handed down a ruling which dramatically changed the landscape of DUI prosecutions.  In Birchfield v. North Dakota, the United States Supreme Court held that a law that imposes criminal penalties for failing to take a blood test in a drunk driving case violated the Fourth Amendment to the Constitution.  The Birchfield decision has had lasting effects on all participants of our justice system.  The webinar will feature a basic overview of the North Dakota DUI process, criminal and civil penalties, the Birchfield discussion, Implied Consent implications, and what the future may hold for our legal community.

Presenter Ashley Flagstad


Ashley is a native of Minot, North Dakota.  She received her B.S. in Criminal Justice from Minot State University and received her J.D. from Thomas M. Cooley Law School in Grand Rapids, Michigan.  She joined Pringle & Herigstad, P.C. following graduation in 2014.


Ashley is licensed to practice in State and Federal Court in North Dakota.  She is licensed to practice in Fort Berthold District Court under the Three Affiliated Tribes Tribal Code.  Ashley is a certified family law mediator for the North Central Judicial District and is listed on the Parenting Investigator and Guardian Ad Litem statewide roster.  Her practice areas include criminal defense, family law, mediation, and general civil litigation.


Ashley is a member of the National Association of Criminal Defense Lawyers, the North Dakota Association of Criminal Defense Attorneys, the State Bar of ND, the Ward County Bar Association, and the North Dakota Association for Justice.  Ashley has been featured in the Washington Post for successfully arguing a case in the western part of ND based on First Amendment protections.  Additionally, she has testified before the North Dakota Legislative Committees on behalf of the North Dakota Association of Criminal Defense Attorneys.
