Presented by the State Bar Association of North Dakota and its Young Lawyers Division. The presentation will begin with the basics: the definition of domestic violence, common victim signs and responses, common offender behaviors, and theories on the cyclical nature of domestic violence. After the basics, the presenters will examine offenders’ and victims’ interactions with the criminal justice system - including the roles of domestic violence task forces, specialized police investigators, advocates, victim witness coordinators, prosecutors, and defense attorneys. Special evidentiary issues - such as those involving the Confrontation Clause and the use of experts to educate juries on counterintuitive victim behaviors - will then be discussed. Next, the presentation will address the impact of orders prohibiting contact and statutory gun restrictions on domestic violence perpetrators. Finally, the presenters will conduct case studies. In doing so, cases involving domestic violence will be analyzed from start (the reporting of abuse to law enforcement) to finish conviction and the aftermath).
