Bar Association will be held June 8-11 in Fargo.
This will be our third “historic” annual meeting and it is going
to be our best ever! We have reserved the Ramada Plaza Suites

Board of Governors approved the following two additional
resolutions to be presented to the membership during
the General Assembly on Thursday June 10, 2004, at 3:30
pm.

Authorizing
Petition for Review of Rule 7.3, N.D Rules of Professional
Conduct
WHEREAS, the State Bar Association is
the voice of the organized bar in the State of North Dakota,
and
WHEREAS, the mission of the State Bar Association is to promote justice
and to serve the lawyers and the people of North Dakota, and
WHEREAS, the recent amendment of Rule
7.3 of the North Dakota Rules of Professional Conduct is
overly broad, may violate the First Amendment rights of
the lawyers of this State and is more extensive than necessary
to serve the interest of the North Dakota Supreme Court
in disciplining lawyers whose in-person contact with prospective
clients is incompatible with the standards of our profession:
NOW, THEREFORE, BE IT RESOLVED: that the
State Bar Association of North Dakota, through attorneys
designated by its Board of Governors after consultation
with the Joint Attorney Standards Committee, petition the
North Dakota Supreme Court for review of the constitutionality
or advisability of Rule 7.3, N.D. Prof. C.
NOW, THEREFORE, BE IT FURTHER RESOLVED:
that the State Bar Association of North Dakota make use
of members willing to volunteer their time and legal talent
in the preparation and presentation of such petition. |

Indigent
Defense Task Force
WHEREAS, the state’s method of providing legal representation
for indigent persons was the subject of significant debate in the 2003 legislative
session and the State Bar Association supported HCR 3004 , which called for an
interim study of the state’s method of providing legal representation to
the indigent, and
WHEREAS, persistent concerns have been
raised with respect to potential for conflicts of interest
in the present administration of the indigent defense contract
system, and
WHEREAS, North Dakota’s indigent
defense contract attorneys cited increasing caseloads and
inadequate compensation as critical problems that need
to be addressed, and
WHEREAS, the state is experiencing a shortage
of attorneys who are willing to provide indigent defense
services, and
WHEREAS, in June 2003, the Board of Governors
of the State Bar Association assumed a leadership role
in proposing solutions to address the problems in the current
system by passing a resolution authorizing the creation
and funding of a Blue Ribbon Task Force to study the feasibility
and desirability of establishing an independent public
defender system , and
WHEREAS, the SBAND Indigent Defense Task Force conducted a series of
meetings, examined the national efforts of the American Bar Association in the
field of indigent defense, reviewed indigent defense reform initiatives in other
states and worked with The Spangenberg Group, a nationally-known consulting group
in the field of indigent defense services, and has now completed its comprehensive
study of the issue and prepared a report and draft legislation implementing its
recommendations, and
WHEREAS, the Board of Governors unanimously approved the Task Force’s
report and proposed legislative changes, and the Task force has now submitted
its report and recommendations to the Interim Legislative Council Criminal Justice
Committee,
NOW, THEREFORE, BE IT RESOLVED: The State Bar Association of North Dakota
hereby accepts and approves the Indigent Defense SBAND Task Force Report and
proposed bill drafts and authorizes the Association officers and staff to take
appropriate steps to submit the report and draft legislation to the 2005 Legislative
Session
for adoption.
BE IT FURTHER RESOLVED: The Association thanks the members of
the SBAND Indigent Defense Task Force for their efforts in completing
this comprehensive study.
