A person who willfully engages in any combination of three or more sexual acts or sexual contacts with a minor under the age of fifteen (15) years during a period of three or more months is guilty of continuous sexual abuse of a child.

ESSENTIAL ELEMENTS OF OFFENSE

The State’s burden of proof is satisfied if the evidence shows, beyond a reasonable doubt, the following essential elements:

1) Within a period of three or more months in [County], North Dakota, the Defendant, _______________, did willfully engage in any combination of three or more sexual acts or sexual contacts with _______________; and

2) _______________ was less than fifteen (15)-years-old. COMBINATION OF SEXUAL ACTS You must unanimously agree that any combination of three or more acts or contacts occurred. You do not need to unanimously agree which three acts or contacts occurred.
