  • Notes: The Commission does not offer an instruction on invasion of privacy. The Supreme Court of North Dakota has made no definitive determination that this tort exists. There have been cases in which the North Dakota Supreme Court has assumed, for the sake of argument, that a cause of action may exist for public disclosure of private information. However, the Court did not affirmatively state that the tort of invasion of privacy exists. The North Dakota Supreme Court has assumed, for the sake of argument, that a cause of action may exist for commercial appropriation of a name without consent. But again, the Court did not determine affirmatively that a cause of action exists for the tort of invasion of privacy.
