  • A person who knowingly places or attempts to place another human being in fear by threatening imminent, serious bodily injury is guilty of the crime of Menacing.

     

    ESSENTIAL ELEMENTS OF OFFENSE

     

    The State’s burden of proof is satisfied if the evidence shows, beyond a reasonable doubt, the following essential elements:

     

    1) On or about [month] [day] [year], in [County], North Dakota, the Defendant, _______________, knowingly placed or attempted to place _______________, another human being, in fear;

     

    2) The Defendant did so by threatening with imminent, serious bodily injury; and

     

    3) The Defendant engaged in the conduct knowingly.
